Bar Exam Format
Montana has adopted the Uniform Bar Exam (“UBE”). The Montana bar exam includes the written components on Tuesday, the multiple choice component on Wednesday, and the Montana component on Thursday.
Day 1
The first day has six MEE questions in the three-hour morning session and two MPT questions in the three-hour afternoon session.
Day 2
The second day has 100 MBE questions in the 3-hour morning session and 100 more in the 3-hour afternoon session.
Day 3
The third day has the Montana Law Seminar (“MLS”) in two, three-hour courses on Montana law. Attendance of the MLS is a prerequisite to admission to the Montana State Bar.
Reciprocity
Montana provides for admission by motion. Montana permits admission by transfer of a passing UBE score obtained in another jurisdiction within the past three years, upon fulfillment of all of the other admission requirements.
Subjects/Topics
The essay portion of the Montana bar exam may test these subjects:
- Agency;
- Article 9 of the U.C.C. – Secured Transactions;
- Conflict of Laws;
- Constitutional Law;
- Contracts (including Article 2 of the U.C.C. – Sales);
- Corporations;
- Criminal Law (including Criminal Procedure);
- Decedents’ Estates;
- Evidence Law;
- Family Law;
- Federal Civil Procedure;
- Limited Liability Companies;
- Partnerships;
- Real Property;
- Torts; and
- Trusts and Future Interests.
Bar Exam Dates
The Montana bar exam is held in February and July. The exam is usually on the last Wednesday and prior Tuesday of each month.

Exam Results
The State Bar of Montana mails the Montana bar exam results to the exam takers approximately seven weeks after administering the exam. The State Bar posts a list of each bar exam’s passers, on its website. The State Bar provides the exam failers with copies of their MEE and MPT exams and their MBE score.
Scoring/Grading
A passing score on the Montana bar exam is 266 on a 400-point scale. The Multistate Essay Exam (“MEE”) is weighed 30%, the Multistate Performance Test (“MPT”) is weighed 20%, and the Multistate Bar Exam (“MBE”) is weighed 50%.
Pass Rate/Stats
Traditionally, the Montana bar exam pass rates are 64% – 93% for total takers, 68% – 96% for the first-time takers, and 33% – 80% for the repeat takers.
